Terms of Service

1. Acceptance of Terms

By accessing or using NOMAD (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

2. Eligibility

You must be at least 13 years old to use NOMAD. By using the App, you represent that you are 13 or older. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Your Account

• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity that occurs under your account.
• You must not share your account or use another person's account without permission.
• Usernames must contain only letters, numbers, and underscores (3–20 characters). Offensive or impersonating usernames may be removed.

4. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of these Terms.
• Attempt to exploit, hack, or abuse game systems (e.g., stat manipulation, API abuse).
• Harass, threaten, or harm other users.
• Attempt to reverse-engineer, decompile, or extract proprietary code or assets.
• Use automated scripts or bots to interact with the App.
• Circumvent rate limits or security measures.

5. Virtual Items and Purchases

The App may offer virtual cosmetic items (such as color palettes) for purchase. These are digital goods with no real-world monetary value and cannot be exchanged for cash or transferred between accounts.

All purchases are final. Refunds are available only where required by applicable law. Contact jordman55@gmail.com for refund requests.

We reserve the right to modify, suspend, or discontinue any virtual item or in-app feature at any time.

6. AI-Generated Content

Chat responses from your Nomad are generated by artificial intelligence. AI responses may be inaccurate, inappropriate, or inconsistent. You should not rely on them for factual information. We are not liable for AI-generated content.

When using "On-device" AI mode, processing occurs entirely on your device. When using server-side or third-party AI modes, your messages are transmitted to the respective provider.

7. Intellectual Property

All App content, including but not limited to pixel art, sprites, code, sound design, and branding, is owned by us or our licensors. You may not reproduce, distribute, or create derivative works without written permission.

You retain ownership of any username or pet name you choose, subject to our right to remove content that violates these Terms.

8. Termination

We may suspend or terminate your account at any time for violations of these Terms. You may delete your account by contacting us at jordman55@gmail.com.

9. Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles.
